Terms of Service Agreement Effective Date: June 23, 2025

This Terms of Service ("Agreement") is a legal agreement between you ("Customer," "User," or "You") and Amcad Graphics LP ("Amcad," "We," or "Us") governing your access to and use of the Amcad Graphics LP website (https://www.amcadgraphics.com/ ) ("Website") and any related products or services.

By accessing or using the Website, you agree to be bound by this Agreement. If you do not agree with these terms, you must not use the Website or any services provided by Amcad.

The Website is intended for informational and commercial purposes. You may use the Website to browse products, request quotes, and contact Amcad for sales and support. Certain products and services are not available for online purchase and may require direct contact with Amcad staff to complete your order.

All product descriptions, specifications, and prices are subject to change without notice. Amcad does not guarantee the accuracy or completeness of any information on the Website. For the most current information and pricing, please contact Amcad directly.

Orders placed through the Website or by phone are subject to Amcad's acceptance. Amcad reserves the right to refuse or cancel any order at any time for any reason. Payment terms will be specified at the time of order or quotation. Some products may require a quote or consultation before purchase.

Orders for Mimaki OEM parts, service replacement parts, and electronic components are subject to the following additional terms:

Shipping for parts orders is calculated after order review and confirmed via a separate invoice. Standard shipping rates shown at checkout do not apply to parts orders. After your order is placed, our team will review part availability, shipping origin (Amcad warehouse, Mimaki USA distribution, or direct from Mimaki Japan), backorder status, and applicable freight method and cost. You will receive a final invoice with confirmed shipping charges before your order is fulfilled. Orders are not charged or shipped until this review is complete and the invoice is accepted.

Lead times vary significantly by part. In-stock items typically ship within 1 to 5 business days. Parts sourced from Mimaki USA typically ship within 5 to 15 business days. Special-order or Japan-sourced parts may require 6 to 16 weeks or longer.

All OEM parts and service replacement parts sales are final. This includes but is not limited to printheads, main boards, slider boards, power supply units, encoders, motors, sensors, cables, electronic assemblies, firmware-related components, and special-order items. Customers are solely responsible for verifying compatibility, diagnosis, and correct part selection prior to ordering.

No returns or refunds will be accepted unless otherwise agreed upon in writing by Amcad. Customers are responsible for inspecting products upon delivery and notifying Amcad of any defects within 3 business days of receipt.

For supplies, consumables, and non-electronic accessories, a 30-day return window applies. Items must be in their original, unopened, factory-sealed condition. Non-defective returns are subject to a 25% restocking fee and original shipping charges are non-refundable. Return shipping is the buyer's responsibility.

For defective items, contact us within 30 days of receipt for an exchange of the identical item. No refunds are issued for defective items, only exchanges. After 30 days, defective product concerns should be directed to the manufacturer.

Returns are not accepted for orders shipped outside the United States.

All signed documents supersede all general return terms stated in this Agreement.

All Mimaki OEM service and replacement parts must be installed by an Authorized Distribution Partner or a certified Mimaki service technician. Installation performed by unauthorized individuals or third-party service providers may void manufacturer warranty coverage and will affect eligibility for returns, support, or warranty consideration under Amcad & Graphics policies. Amcad accepts no liability for damage, malfunction, or injury resulting from improper installation.

The MimakiPartsAdvisor and any AI-assisted parts identification tools provided on this Website are for reference purposes only. Part numbers, compatibility information, and assembly references returned by the tool are sourced from Mimaki's official maintenance documentation but are not guaranteed to be current, complete, or applicable to your specific equipment configuration.

Amcad assumes no liability for parts ordered based solely on AI tool output. Customers are responsible for independently verifying part numbers, compatibility, and suitability before placing an order. When in doubt, contact us directly at info@amcadgraphics.com or 972-245-7883.

All content on the Website, including but not limited to text, graphics, logos, and images, is the property of Amcad or its licensors and is protected by intellectual property laws. Unauthorized use, reproduction, or distribution is prohibited.

By using the Website, you consent to the collection, use, and disclosure of your personal information as described in Amcad's Privacy Policy. Amcad may share your information with third-party service providers as necessary to fulfill your orders or provide support.

Amcad shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Website or any products or services provided by Amcad. This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

You agree to indemnify and hold harmless Amcad, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Website or your breach of this Agreement.

Amcad reserves the right to modify this Agreement at any time. Changes will be effective immediately upon posting on the Website. Your continued use of the Website after changes are posted constitutes acceptance of the modified terms.

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under or related to this Agreement shall be resolved exclusively in the courts of Dallas County, Texas.
